Terms of Service

This is an English translation of the Dutch terms. In case of any discrepancy, the Dutch version prevails.
These terms apply to every use of the services of Netlonics, established in Almelo, the Netherlands. By creating an account, ordering a Pack or otherwise using our services, you agree to these terms. If you do not agree, do not use the service.
1. Definitions
- Netlonics, we, us — the trade name under which the service is offered, established in Almelo, the Netherlands.
- Customer, you, your — the natural or legal person entering into an Agreement with Netlonics.
- Service — game server hosting and related services as described on netlonics.com.
- Pack — a specific game or software configuration (e.g. Minecraft Paper, ARK, Palworld) with associated prices and specifications.
- Server — the virtual game server instance allocated to you under an Agreement.
- Account — your personal protected environment on netlonics.com.
- Agreement — the agreement between Netlonics and you for the provision of one or more Services.
2. Applicability
These terms apply to all offers, orders and Agreements. Deviations only apply when we have confirmed them in writing. Customer's own general terms are explicitly rejected.
We may amend these terms. Material changes are announced at least 30 days in advance by email or via your dashboard. If you do not agree with the change, you may terminate the Agreement against the effective date of the change.
3. Offer and conclusion
Offers on netlonics.com are non-binding and may contain pricing or typographical errors. An Agreement is concluded once we confirm your order by email or via your dashboard, and payment has been successful.
We may refuse orders or request additional information before delivery — including in case of suspected abuse, previously refused account, or payment risk.
4. Delivery and use
After successful payment, your Server is provisioned automatically. Connection details appear on your dashboard and are sent by email.
You are responsible for:
- The management of your Server (configuration, mods, plugins, world files).
- The content you host on your Server.
- Making and keeping your own back-ups (see § 6).
- Keeping your account credentials confidential.
5. Prices and payment
All prices are in euros and — unless stated otherwise — exclude VAT. For Dutch consumers 21% VAT applies; for customers outside the Netherlands the rules for cross-border digital service supply apply.
Payment is handled by our payment processor Stripe. We accept iDEAL, credit card, SEPA, and the other methods supported by Stripe.
- Subscriptions are charged in advance per period (monthly or yearly) and renew automatically until cancellation.
- One-time purchases are charged immediately and do not renew automatically.
- In case of a failed or reversed payment, we suspend the Server within 72 hours. If the outstanding amount is not settled within 7 days, we terminate the Agreement and delete the Server in accordance with § 11.
Price changes for subscriptions are announced at least 30 days in advance. Not agreeing? You may cancel against the effective date.
6. Back-ups — your responsibility
We provide on-demand back-ups that you create, download, restore and delete yourself from the dashboard, on a best-effort basis and with no guarantee. We do not make automatic back-ups on your behalf. Back-ups may fail, become corrupted, or be incomplete.
You are responsible for making and keeping your own, independent back-ups of world files, plugins, configurations and any data you consider important. We are never liable for loss of data, regardless of cause (including crashes, hardware failures, human error on our side or yours, or termination of the Agreement).
7. Availability and uptime
We do our best to keep the Service available 24/7, but we do not guarantee any specific uptime. Service Level Agreements (SLAs), uptime credits or similar guarantees are not provided.
Maintenance, updates of our control plane or node daemon, restarts of physical nodes, network outages, DDoS attacks, and outages of our suppliers may cause downtime. We aim to announce planned maintenance, but cannot always do so (emergency updates, security patches).
Unavailability does not entitle you to a refund, discount or compensation, except where mandatory law requires otherwise.
8. Acceptable use
The Acceptable Use Policy applies to your use of the Service. In case of a violation, we may immediately and without notice suspend or terminate the Server, without refund of any amounts already paid.
In addition, use that:
- Violates Dutch or European law.
- Infringes third-party rights (intellectual property, privacy, reputation).
- Damages our infrastructure or that of third parties (DDoS, port scans, brute force, malware distribution).
- Disproportionately consumes resources compared to the Pack tier purchased,
is prohibited. We determine in our discretion whether a violation has occurred and are not obliged to warn first.
9. Intellectual property
All rights to the Netlonics website and dashboard, our logo and our text and visual content belong to us or our licensors. None of it may be reproduced or made public without our prior written consent.
For mods, plugins, modpacks, world files and other content you install on or upload to your Server: that content remains your responsibility. You warrant that you have the necessary licences and rights. In the event of an (alleged) infringement, you indemnify Netlonics against all third-party claims, including reasonable legal costs.
10. Right of withdrawal (consumers)
As a consumer you are in principle entitled to a 14-day right of withdrawal for digital services. This right expires as soon as we have started performance with your express prior consent and you have declared that you waive your right of withdrawal (Art. 6:230p sub g of the Dutch Civil Code). At checkout we explicitly ask for this consent via a tick box.
Trying the Service before you buy. Rather than a money-back period, we offer a free trial so you can test the Service before any payment is made (where a trial is available for your Pack). Outside the statutory right of withdrawal described above, any refund is at our sole discretion and assessed case by case (for example, an unresolved fault on our side). This is not a guaranteed money-back period and confers no entitlement. Any such request must be submitted by email.
For subscriptions in continuous use: you may cancel at any time against the end of the current billing period (see § 11). Periods already elapsed are not refunded.
11. Term, termination and data retention
Subscriptions run for an indefinite period, each time renewing for the selected term (monthly or yearly), until either party cancels.
- You cancel via the dashboard or by email. Cancellation takes effect at the end of the current billing period; mid-period cancellation does not entitle to a refund of amounts already paid.
- We may terminate or suspend the Agreement in case of payment arrears, abuse, or violation of the AUP (§ 8). Outstanding receivables remain due.
- We may also terminate the Agreement even where there is no shortcoming on your part, solely for commercial or operational reasons — for example if we cease our activities (wholly or partly) or withdraw a Pack from our offering. In that case:
- We announce the termination at least 30 days in advance in writing, by email and via your dashboard.
- If we terminate an entire Pack, we do so on a non-discriminatory basis: the termination then applies to all Customers of that Pack.
- We refund, pro rata, the amount prepaid for the remaining, unused part of the current billing period. The exclusion of refunds in § 10 and in the first cancellation point above does not apply in this case; this refund is a right, not a goodwill gesture.
- Retention and deletion of your Server data follows the process described below (7 calendar days).
Data retention after termination: after cancellation, termination or non-payment, we retain your Server data for 7 calendar days. Within this window you may restore by reordering or (on request) receive a download of your latest back-up. After that, all world files, back-ups and configurations are permanently deleted, without further notice.
12. Liability
Our liability for damages arising from or in connection with the Agreement is limited to the amount you paid in the 3 months preceding the damage-causing event, with an absolute maximum of €500 per event and €1,500 per calendar year.
We are never liable for:
- Indirect damage, consequential damage, lost profits, lost revenue or missed savings.
- Loss of data, world files, plugins, configurations or gameplay progress.
- Loss of community members, donations, leaderboard rankings or reputation.
- Damage from downtime, latency, lag, packet loss or network issues.
- Damage from (D)DoS attacks, even if our DDoS protection is circumvented.
- Damage caused by acts or omissions of you, your players or your sub-users.
- Damage caused by mods, plugins, modpacks or other software installed by you.
These limitations do not apply to damage caused by Netlonics' intent or conscious recklessness, or insofar as mandatory law precludes them.
A claim against Netlonics expires 1 year after the claim arises.
13. Force majeure
We are not liable for non-performance or delayed performance due to force majeure. Force majeure includes, among other things: outages at our data centre supplier, internet outages, DDoS attacks, power outages, cable breaks, cyberattacks, software bugs in our control plane or the underlying OS, supplier bankruptcies, government measures, pandemics and strikes.
In case of force majeure lasting longer than 30 days, either party may terminate the Agreement without liability.
14. Personal data
The processing of personal data is described in our Privacy Policy. By using the Service you consent to that processing.
For a product that is not yet available, you may optionally join a launch waitlist by submitting your email address. This is based on your explicit consent, is used only to notify you when that product launches, and is governed by our Privacy Policy. You can withdraw at any time.
15. Sub-users and players
You may add sub-users within your Account who get access to the management of your Server. You remain responsible for the conduct of these sub-users and for the compliance with these terms by all persons playing on or managing through your Server.
16. Changes to the Service
We may adapt the Service, Pack specifications, prices and functionality for technical, commercial or legal reasons. Material changes adversely affecting you (such as a price increase or reduction of resources) are announced at least 30 days in advance, with a right to cancel.
17. Assignment
You may not assign your rights and obligations under this Agreement to a third party without our written consent. We may assign our rights and obligations to a legal successor or upon transfer of (part of) our business; you will be informed in good time.
18. Complaints
Got a complaint? Email us first — we aim to respond within 5 business days. For consumers there is the additional option to submit a dispute to the European ODR platform (https://ec.europa.eu/consumers/odr). We are not affiliated with a disputes committee.
